Hire Agreement

West Drive Executive Hire Agreement

  1. Hire Agreement West Drive Executive (hereinafter referred to as the “Owner”) agrees to rent the vehicle described overleaf to the Hirer, who agrees to hire the vehicle under the terms set forth in this agreement. The Owner warrants that the vehicle is roadworthy.

  2. Extension of Hire Period The Owner may extend the hire period at the request of the Hirer, provided that the Hirer pays any additional deposit(s) required by the Owner. In the event of an extension, the new return date and time shall become the due back date unless stated otherwise in the agreement. Under no circumstances shall the hire period exceed three months in total.

  3. Warranties and Responsibilities of Hirer and Additional Driver a) The Hirer agrees to return the vehicle in the same condition as received, with ordinary wear and tear excepted, by the due date specified overleaf.

    b) The Hirer agrees not to:

    • Use the vehicle for hire, reward, or any unlawful purposes.

    • Remove the vehicle from England, Scotland, or Wales without prior written consent from the Owner.

    • Permit the vehicle to be operated in violation of any traffic laws.

    c) The Hirer further warrants:

    • The accuracy of the information provided to the Owner.

    • That in business hires, the agreement is entered into on behalf of the Hirer by an authorized representative.

    • That the vehicle will not be driven by any person under 25 or over 70 years of age.

    • That the vehicle will not be used for motor sports, racing, towing, or reckless driving.

    • That the vehicle will always be locked when unattended and the keys secured.

    • That the driver holds a valid driver’s license.

    d) If the Hirer breaches this agreement, the Owner reserves the right to terminate the agreement, seize the vehicle without notice, and hold the Hirer liable for damages.

    e) The Hirer authorizes the Owner to verify personal, driving, and credit information through relevant agencies.

  4. Payment Terms The Hirer agrees to pay the Owner on demand: a) Mileage and service charges as specified overleaf. b) Any applicable insurance fees. c) All fines, penalties, and legal fees incurred during the hire period. d) Refueling charges, if applicable. e) The cost of repairing any damage to the vehicle, including administrative fees, loss of revenue, and towing charges. f) The fair market value of the vehicle in the event of theft, unless covered by insurance. g) Drop-off fees if the vehicle is not returned to the designated hire office without prior written consent. h) Any outstanding balances, which may be charged to the Hirer’s credit card.

  5. Insurance a) If the Hirer provides their own insurance, they must maintain comprehensive coverage for the vehicle’s full market value. The Owner reserves the right to claim hire charges until repairs are completed. b) If the Owner provides insurance, the Hirer must pay the applicable excess for any damages. A copy of the policy is available at the Owner’s registered office.

  6. In Case of an Accident The Hirer must: a) Notify their insurer (if using own insurance) and the Owner within 24 hours of an incident. b) Complete and submit an accident report to the Owner within 24 hours. c) Not admit liability to any third party. d) Provide the Owner with any legal documents received regarding the accident. e) Collect and provide details of any witnesses. f) Indemnify the Owner against all costs not covered by insurance.

  7. Indemnity The Hirer agrees to indemnify the Owner against any claims, losses, liabilities, or damages arising from the hire and operation of the vehicle. If the Hirer lacks insurance, they agree to compensate the Owner for any losses incurred.

  8. Payment Authorization The Hirer authorizes the Owner to charge their credit card for outstanding amounts, including charges rejected by third-party billings.

  9. Final Audit All charges are subject to final audit and adjustment.

  10. Governing Law and Jurisdiction This agreement is governed by the laws of England. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

Statement of Liability I confirm that I have declined CDW and/or TPW as my credit card company provides coverage. I authorize West Drive Executive to charge my nominated credit or debit card for any damages, theft, or loss of use costs related to the vehicle.
